I can’t tell you how unsatisfying it is to have the gift of seeing realities that others miss, ignore, or try to hide. I’m reminded of the R.F.K., Sr. quote, “Some men see things as they are, and say why. I dream of things that never were, and say why not.” Except, because our current state of chaos, bordering on insanity, brings on nightmares rather than dreams, my quote would be, “Some men fail to see things as they are, and say ‘That’s nice.’ I’m haunted by the way things really are, and say, ‘Snap out of it!” And so, once again, we shall revisit the prediction I made some time ago, and put into print on these pages in the column, What to do with Joe (12/1/2023). Here are some excepts from that one. “Old Joe served that purpose [getting rid of Trump], but it now looks like he’s outlived his usefulness to the Democrat Party, and it may be time for him to go.” “The problem for Democrats isn’t that Biden is inept, senile and corrupt. They’re willing to put up with that for another four years, the country be damned. The problem is that they may not be able to get Old Joe reelected.” “If Biden can’t control the Justice Department, he and other family members could be indicted. Old Joe could do a convincing Vinny the Chin impression and escape prosecution, but not the others.” This was a reference to mobster Vinny the Chin Gigante, who when the Feds were closing in on him, wandered around the streets of New York in his bathrobe to perfect an incompetency defense. It worked for Vinny, and I thought it also might work for Joe.
Only it looks like Joe may not need to bother, since the Delaware Special Counsel has decided that he won’t be charged for possessing and disclosing classified documents, primarily because, he is “an elderly man with a poor memory.” The report was remarkable, and as a lawyer very insulting, because, in order to clear Biden of doing things with classified documents much worse than the things President Trump has been accused of, the Special Counsel proved himself to be a double-talking bullshit artist, with the flexibility of a world-class contortionist. He starts out by saying, Joe Biden “willfully retained and disclosed classified materials.” Stop right there! This satisfies the elements of two federal crimes, removing materials with the intent to retain them, and willfully disclosing them to an unauthorized person. But the Counsel didn’t stop right there. What Biden did was illegally take classified documents in 2007 as a Senator, and in 2015 and 2017 as VP. The 2015 papers related to Ukraine, from which Biden had just returned, after forcing that nation to fire the prosecutor who was about to uncover Hunter Biden’s misconduct. The 2017 papers included top secret Presidential Daily Briefs, and other documents relating to Afghanistan, marked Top Secret/Sensitive Compartmental. And unlike Donald Trump, Biden didn’t keep them in a locked room, guarded by the Secret Service. Instead, Biden put them in a broken box in his garage. He also had handwritten journals containing classified information in an unlocked drawer in his basement, and he disclosed classified information to the ghostwriter of his autobiographies. The Special Counsel found that the documents taken and held as VP were not criminal because, “As vice-president and president, Biden had the authority to keep classified documents in his home,” which raises the question, why has Trump been indicted for doing precisely that? But the Counsel went even further. Totally abandoning his proper role as a prosecutor, he found that Biden could raise as a defense his age and poor memory, making it difficult to prove he acted willfully. This after telling us that he found Biden “willfully retained and disclosed classified materials.” In essence, the Counsel is saying Biden would have been indicted, but for the fact he’s incompetent to stand trial. This is a bombshell. The standard for incompetence to stand trial is very high. For example,right now I have a client who killed his father. When arrested, he told police he had just spoken with his dead father, who told him he was hiring a lawyer to represent him. He was found competent to stand trial. A defense of “I must have just forgotten” doesn’t cut it. In any event, if Biden’s condition even raises the remote possibility that he’s incompetent to stand trial, he has no business serving in any elected office, much less as President of the United States. Unsurprisingly, the Biden Administration has dug in. They celebrated the decision not to charge, and bashed the portion of the report questioning his competence. They’re right about one thing. If Biden indeed is incompetent, the prosecutor has no business raising such an issue. It’s what’s known as an affirmative defense that must be raised, if at all, by a criminal defendant. What’s more, if raised, it requires psychological examinations by doctors for the defendant and the government, and a court hearing. The Special Counsel had none of that. He just threw it out as an excuse not to charge Sleepy Joe, who indignantly swears he’s in full possession of his faculties. In this case, Biden kept the materials after being told by his staff it was wrong. He told the ghostwriter, “I didn’t want to turn them in.” That is an admission of wilfulness. As to the handwritten notebooks, Biden said, “The notebooks are my property. Every president before me has done the exact same thing.” So once again, why has Trump been charged with having documents he arguably could retain under the Presidential Records Act, while Biden will not be charged for having and disclosing materials he took before he was president? Good question. The Special Counsel’s explanation was that he may have thought he could legally retain them, and may have forgotten about them. Neither circumstance is a defense. To this Biden protests, “My memory is fine.” Whether it is or isn’t, the rationale used to avoid prosecution stinks. One thing is clear, at least to me. This Special Counsel report did not come when it did by coincidence. The report is just the next chapter in the plan to engineer the eventual replacement of Biden on the 2024 ticket. The Special Counsel is a cog in the Obama machine. At this writing, 86% of Americans have concluded that Biden lacks the mental acuity to be president, and 86% of Americans agree on little else. As I said in December, Joey the Chin has to go. Here’s hoping Joe remains stubborn and that his inevitable removal sparks a political bloodbath that tears the Democrat Party to pieces.
With utter chaos on the border, and the Biden Administration’s attempt to ram through an omnibus immigration/foreign aid bill, designed to waste billions of dollars more by funding the Ukraine war, while providing Corrupt Demented Imbecile Joe Biden with cover for the border fiasco he created, this week’s offering will be on the subject of asylum. More specifically, who or what groups are in need of asylum. We’ll start by defining terms. Like many words, the word “asylum” has different meanings. Definition One is “government protection given to people who have been forced to leave their own countries for their safety or because of war.” This is the type of asylum that’s currently in the news. I’ll use it in a sentence: Joe Biden has admitted more than 10 million illegal aliens, many of whom pretend to be seeking asylum. An equally valid definition of asylum is Definition Two – “a hospital for people with mental illnesses,” a/k/a a lunatic asylum. I’ll use this one in a sentence: Any elected official who supports what Joe Biden has done to our border, or who votes for the Senate’s proposed Emergency National Security Supplemental Appropriations Act, belongs in an lunatic asylum. One useful rule of thumb for evaluating Congressional acts is to assume that the real purpose is not what its title suggests. A New Jersey appellate court decision I’m fond of once explained that title of a law doesn’t control the plain words of a statute. “Like the inscription on a tombstone, it serves only to indicate what lies below.” The Senate bill is no exception. It does nothing to enhance national security, quite the opposite. The bill is supposed to cost us $118 billion. All that money should help the Border Patrol, right? Wrong! First of all the so-called border control part of the bill is only $20 billion. $60 billion goes to Ukraine, to replenish Ukranian Swiss bank accounts. Israel would get $14 billion. And whatever the $20 billion in border money is intended to do, it won’t secure our border. Without this “bipartisan deal,” Biden has let 10 million illegal invaders into the country, then turned them loose. In 2023 alone, more than 3 million were admitted. Asylum seekers right? Well, some claim they are, but it’s time for facts. To get asylum one must be a refugee, that is, a person: of special humanitarian concern to the United States; who demonstrates they were persecuted or fear persecution due to race, religion, nationality, etc.; who is not firmly resettled in another country; and is admissible to the United States. Over 75 % of asylum seekers don’t qualify, but that’s moot today, because Biden is letting millions loose, without knowing whether they’re even admissible, overlooking little things like being terrorists, convicted felons, or carriers of communicable diseases. Simply put, Biden has admitted millions of invaders, some of whom commit crimes. Last week 7 invaders beat up 2 NY cops. They were immediately released from jail, and they showed their gratitude –
And Biden wants to keep letting them in. Due to the court backlogs, alleged asylum seekers are given court dates 6 or 7 years in the future. Because we have no idea where they are now, much less in 2030, the odds they will appear in court are practically nil. It’s all a sick joke on the American citizen who has been relegated to second-class status by Joe Biden. But the bill fixes all this right? Wrong! The bill that Sleepy Joe and the detestable Chuck Schumer claim will secure the border and is needed to provide the President with the power to act, is just another Washington boondoggle. Ever wonder why funding for Ukraine and Israel is in a border security bill? It’s what’s called “poison pill legislation.” You take things that a majority of the Congress want, and package them with things that would never pass if presented by themselves. You want to help Ukraine and Israel? Then you have to swallow the poison, or else you get nothing. The poison in this bill is in the border provisions. First, Biden needs no legislation to secure the border. Existing law authorizes the President “to suspend the entry of all aliens or any class of aliens” whose entry he “finds … would be detrimental to the interests of the United States.” President Trump used this provision to secure the border without Congressional action. The Supreme Court ruled he had the authority to do so. On his first day in office, Biden cancelled 89 Trump border directives, and the illegals poured in. The idea that Biden needs new authority is a lie, what he needs is a pair of balls and the will to do his duty. He lacks both. And forget the bullshit stories about how the flood of migrants will be controlled. Without the bill 3 million invaders in one year right? Here’s the proposed “fix.” If the number of invaders exceeds 5,000 a day over a seven day period, Homeland Security would shut the border – “temporarily.” In 2018, we were told 1,000 a day was a humanitarian crisis. Now we’re going to legislate a 500% percent greater crisis, and call it a fix? Plus, who decides if the 5,000 invader limit has been reached? Mayorkas? And a “temporary shutdown” could be 8 hours, enough time to replenish the Obama-phones and Target gift cards. In a word, this is bullshit. The flood will continue. What this bill really is, is a can’t lose proposition for Democrats. If it passes, Democrats get to maintain the flood of invaders, while pissing more money down the Ukrainian rathole, and at the same time telling voters they “fixed” the border mess. If it fails to pass, Democrats get to try to blame the entire border fiasco on Republicans – “Oh, if only Republicans had voted for the bill, all would have been well; instead they did the bidding of Evil Orange Man.” And millions will believe this shit. As this is written, more than 20 Senate Republicans are opposing the bill, and it appears dead -for now. A Monday Republican conference on the bill led to angry shouting. House Speaker Johnson has already pronounced the bill “dead on arrival in that Chamber, “I’ve seen enough. This bill is even worse than we expected, and won’t come close to ending the border catastrophe the President has created. As the lead Democrat negotiator proclaimed: Under this legislation, the border never closes.” Progressive lunatics don’t like it because it doesn’t legalize the Dreamers. They should take that up with Chuck Schumer, who turned down President Trump’s 2018 offer to legalize 1.6 million Dreamers, in return for real border security. Sleepy Joe already has said this all or nothing, promising to veto any bill that includes only funds for Israel, without the Ukraine and border boondoggles. Have it your way Joe, I’ll settle for nothing. Republican Senators who were planning to support this mess are hearing it from angry voters, and even the bill’s sponsor, Jim Lankford, has suggested he may vote against it. Maybe he’s having a lucid interval. Anybody who supports this insult qualifies for asylum, under Definition Number Two. They should be institutionalized immediately.
Ever wonder just how the Left can get away with destroying 248 years of American culture, our form of government, our achievements, our national security, and our personal freedoms, and still make a large segment of our society believe that it’s the fault of capitalism, Republicans, Donald Trump, Vladimir Putin, or anyone other than themselves? I finally figured it out. It’s magic. All magic is, when you boil it down, is sleight of hand – misdirection. The magician gets you to look this way, while he’s doing something else you don’t notice. There’s another apt analogy. Just for the record, we should avoid memes comparing Democrats to the devil at all costs. So here’s another one. Remember the Al Pacino movie, The Devil’s Advocate? In it, Pacino plays John Milton, a/k/a Satan. Milton tells his son, “Guilt – it’s like a bag of f***in’ bricks. All you gotta do is set it down….Who are you carrying all those bricks for anyway? God? Is that it? God? Well, I tell ya, let me give you a little inside information about God. God likes to watch. He’s a prankster. Think about it. He gives man instincts. He gives you this extraordinary gift, and then what does He do? I swear, for His own amusement, His own private cosmic gag reel, He sets the rules in opposition. It’s the goof of all time. Look, but don’t touch. Touch, but don’t taste. Taste, don’t swallow. And while you’re jumpin’ from one foot to the next, what is He doin’? The people who would gladly cancel, draw and quarter you for dropping an errant pronoun. You know, Leftist morons. I’ve dealt with this issue before on these pages, in Freedom of Suppress (7/2/21, see the archive below). That article dealt with the speech code of Brandeis University, which was ironic and tragic because Louis Brandeis was a champion of free speech. The university was pushing a speech code, which compiled an Oppressive Language List, that declared words such as “picnic” unacceptable, for being associated with lynchings of Black people. Brandeis suggested “outdoor eating” instead. “Off the reservation” was disapproved, in favor of “disagree with the group.” It might trigger Native Americans. Then again, “trigger warning” was also taboo, because the word “trigger” might be connected to guns. For the record, it’s alright to be triggered, so long as you don’t say “trigger.” Clear? The words “you guys,” “ladies and gentlemen,” or even “she” or “he,” were disapproved for suggesting that there are only two genders. Brandeis preferred words such as “Y’all,” “folks” or “folx” (which isn’t even a real word). But why dwell on vocabulary? When you’re righting imaginary wrongs, only an imaginary word will do. What got me off on this kick? They’re at it again, but this time even stupider. Something called the European Union’s Institute for Gender Equality is now attacking, as one of its highest priorities, wait for it – the 58 year old opening theme to the TV series Star Trek. I shit you not. We all remember the opening –

No, it’s not the split infinitive that’s the crime here, it’s that offensive word. Dare I say it? No, it’s too painful! Okay, okay, it’s the word “Man” that has the EU’s speech police agency’s knickers in a twist. Their 61-page toolkit on gender-sensitive communication has flagged Star Trek for one of the most egregious speech crimes ever conceived in the mind of a loony Leftist, insufficient inclusivity. They claim the word “Man” in the opening omits or excludes women, which is not only dumb, but also indisputably wrong. The reference to “Man” had nothing to do with gender, but instead was a reference to the definition of the word which means now, just as it did in 1966, “humankind.” Plus, anyone who’s ever actually seen the series or the franchise knows that it pioneered the inclusion of women in positions of authority. But the damage is done. They’ve now triggered (there’s that word again) the nearly 93 year old actor who played James Tiberius Kirk all those years ago, William Shatner. And Shatner’s not buying the bullshit. He hit back on social media. “Presentism at work yet again. Why start at Trek? Isn’t it better to start at the beginning and redo foundation material such as the Magna Carta, religious writings, works of Shakespeare before worrying about a silly TV show opening that reflects social commentary of the time? If people are offended by 6 seconds of dialogue recorded in 1966 without a modicum of understanding of the social issues at the time there’s bigger issues that they need to deal with first – like educating themselves.” Bravo Bill. The only good thing about getting old is being free to tell insane progressives to go shit in their hats. The EU has a list of “good” and “bad” words, like that of Brandeis.

They’ve also got a paper about “energy poverty,” which decries the “gender aspects of the rising cost of living and the impact of the energy crisis.” Huh? When women buy gasoline and food, do they get charged more than men? If you don’t understand this, don’t feel bad. They don’t either. They say energy poverty is one of the key contributors to widening inequality, “to what extent, we hardly know.” It puts me in mind of the joke about the New York Times headline the day before the apocalypse, World Ends Tomorrow: Women and Minorities Hardest Hit. Which brings us back around to the original theme. None of the supposed outrage of the Left over speech is real. It’s a magician’s trick. While you’re busy jumping from one foot to the other trying to find the acceptable words, they’re hard at work stealing your freedom. As for myself, I believe in speaking plainly, so I won’t take advantage of the speech code and say progressives are experiencing a modicum of intestinal distress. They’re simply full of shit.
Thus far we have had the Iowa Causcuses and the New Hampshire primary. In both these contests the issue of illegal immigration is the leading issue for voters. In New Hampshire, illegal immigration runs 10 points ahead of the economy for voters. This is an amazing result, given the fact that the Biden Administration has run our economy into a ditch, with record-breaking inflation, and the highest interest rates in 40 years. Last week I paid $8 for a jar of pickles. If the problem on the border is a more pressing than that, then “Houston, we have a problem.” As this is written, Corrupt Demented Imbecile Joe Biden is continuing to follow a border policy which has seen more than 10 million illegal aliens let loose in the United States. The U.S. Border Patrol has been “fundamentally transformed” from the protectors of our border into a Welcome Wagon organization, whose job has become welcoming the invaders, ignoring the fact that these predominantly military aged males really aren’t related to the minors they’re traveling with, and providing them with food, clothing, free phones and free transportation to the locations of their choices, while perpetuating the fiction that they’re really migrants seeking political asylum. These invaders have been transported to previously declared “sanctuary cities” which lately have realized that having thousands of invaders sleeping on their streets isn’t a good idea. At first, it was suggested that the decision to erase our southern border was part of a Democrat plan to inundate the southern States with replacement voters to turn the Red State’s of the South Blue, and ensure endless Democrat rule. But, if true, as with most things Democrat, the mindless plans of the Left failed to consider the unintended consequences of their folly. Iowa and New Hampshire are about as far from border States as one can imagine. Therefore, the fact that the voters in these States list illegal immigration as the Number One issue motivating their votes is telling. If Democrats thought that the impact of the alien invasion would be limited to the southern border, they miscalculated. The Biden policy of transporting aliens all over the map, coupled with the efforts of States like Texas, which have been shipping aliens by bus to cities like New York and Chicago, have transformed virtually every State into a border State, and the results have not benefited the Democrats. In Chicago, loyal Democrat voters, many of them minorities, are incensed with the Biden Administration policies. A recent poll in New York of all places found that Hispanic voters in New York favor Trump over Biden by 3 points. That spells trouble for Sleepy Joe. A bitter court battle is going on in Texas. Our Constitution guarantees that the federal government shall protect the States from invasion. The arrival of up to 14,000 illegal aliens a day in Texas is nothing less than an invasion. Yet the Biden Administration, instead of protecting Texas from invasion, is encouraging and giving aid and comfort to the invading armies. Texas took action. The State placed razor wire along the border and took over control of the park in Eagle Pass, which has been the most frequent entry point of the invaders. The Biden Administration sued Texas to get the razor wire removed. A federal District Judge ordered Texas to remove the barriers. The federal Circuit Court ruled that Texas could keep the barriers in place. This week, the Supreme Court voted 5 to 4 that the barriers could be cut away by the Border Patrol, pending litigation on the lawsuit. Many conservatives have blasted Justice Coney-Barrett and Chief Justice Roberts for voting with the liberal Justices on this issue. I don’t like the decision either, but keep in mind that this is a preliminary ruling. The case still needs to be tried. And like it or not, the Constitution gives the federal government the responsibility for governing immigration, and the Supreme Court is supposed to presume that the Legislature and the Executive will diligently carry out their responsibilities. Our eyes tell us that the Legislature has failed to take action and that the Executive is actively working against the interests of American citizens. However, given this disconnect, the Supreme Court may rightly have concluded that this glaring problem is best left to the voters in November. The Biden Administration hasn’t learned anything from the recent polls that indicate that a large majority of voters oppose the border invasion. Kamala Harris this week parroted the Democrat line, claiming that the immigration system is “broken.” According to Kamala, there’s a easy fix – “Total Amnesty.” As this is written there is an impending Senate Immigration bill which is being touted as a solution to the immigration problem. The fact that the proponents of this “deal” have, so far, refused to disclose its details has prompted many to suspect that this “deal” is just another globalist giveaway designed to legalize millions of invaders to provide cheap labor. Time will tell. But one more take away from the New Hampshire primary. New Hampshire permits unaffiliated voters to vote in either primary. MSNBC reported that more than half the voters in the Republican primary were not Republicans, but were “unaffiliated.” Trump won by 10 points anyway. And what about Nikki Haley? CNN reports that 70% of her votes came from non-Republicans, and only 27% from Republicans. By contrast, Trump got 70% of Republicans and 27% of the others. Regardless, Nikki Haley still thinks she won. It must be the new math.
FRANK ON FRIDAY-The Late News
This week’s title doesn’t refer to the news programs that are aired in the late evening, but rather to the alarming trend among segments of the media to ignore the obvious for years, and much later announce as “breaking news” events that they had helped to suppress. I’m referring to the supposed bombshell reporting by Matt Taibbi and Alex Gutentag, that the US Intelligence Community asked foreign spy agencies in the United Kingdom, Canada, Australia, and New Zealand to surveil 26 associates of Donald Trump in the run-up to the 2016 election, which fueled allegations that the former president’s campaign had been colluding with Russia. Warrantless surveillance of US persons is specifically prohibited by US law. You, no doubt, will recall that much of the impetus for what became the Trump/Russia Collusion investigation was gleaned from the phony dossier that Hillary Clinton bought from former British MI5 spy Christopher Steele, but that came later. The wheels of the conspiracy were set in motion by the CIA early in 2016, and once again let me say, this is not new information. I reported all of this stuff years ago. On March 17, 2017 in Journalism Rest in Peace, and on March 24, 2017 in Who Were Those Unmasked Men? I discussed the report that investigators wiretapped Trump Towers. The media denied it. It turned out to be true. On June 1, 2018 in Spy vs. Spy, and on June 8, 2018 in The Deep State Lives, I reported that Donald Trump and his campaign were the targets of a multi-agency investigation which included the use of government informants who planted the information that the government used to start the Russian Collusion investigation. The Democrats and the media denied the allegation as “outrageous.” Five years and eight months ago, I wrote, “CIA Director John Brennan sprang into action. The American Spectator has pieced together the sordid timeline. We were led to believe that the investigation began in May 2016, when George Papadopolous told Australian envoy Alexander Downer Russia “had dirt” on Hillary Clinton, including her emails. Now we know the truth. In March 2016, the CIA arranged for one of their informants, British academic, Joseph Mifsud, to meet with Papadopolous. In April 2016, Mifsud fed Papadopolous information that Russia had dirt on Hillary and her emails.” “Brennan shared the information with James Comey, and the FBI launched Operation Crossfire/Hurricane, which was controlled by “the Langley Working Group,” a government task force including CIA, FBI, Treasury, Justice, the DNI (James Clapper) and the NSA.” “Papadopolous later was introduced to a second CIA spy, Stefan Halper, who also passed on the “Russian dirt on Hillary” information to Papadopolous. The CIA also sent an informant to meet with Carter Page in London, perhaps the same professor Halper” who worked in London. Then, FBI agent Peter Strozk, the FBI’s conduit to CIA Director Brennan, the same agent who interviewed General Flynn, and Huma Abedin and Hillary Clinton … was tasked to go to London to interview Australian diplomat Alexander Downer, to whom a drunken Papadopolous repeated what he had been told by Mifsud. So the CIA and FBI planted the story it used to begin the Trump investigation with people working for Trump. Hillary then bought the Steele dossier from a group called Fusion GPS. Steele got what he put in the dossier from Russian intelligence agents. Get that? The phony dossier that alleges Trump colluded with Russia, came from Hillary, who bought it from a guy (Steele) who got it from the the Russian FSB. You can’t make this shit up. Steele later testified under oath that the allegations in the dossier about Trump weren’t true. In 2020, declassified documents proved that the FBI misled both the Congress and the FISA Court by using the dossier, which they knew was false, to get wiretap authorizations. Nobody has gone to prison for that. They should. The intelligence agencies then sent a Russian woman linked to Fusion GPS to see Donald Trump, Jr. He threw her out, but the meeting provided a pretext for more wiretapping of Trump employees after the election. Last March, Special Counsel John Durham wrapped up a four year investigation which concluded that the FBI investigation of Trump’s alleged collusion with Russia was “seriously flawed” and had no basis in evidence. I guess “seriously flawed” means “blatantly illegal” because that’s what it was. Our government, you know, the same lying assholes who keep lecturing us on “threats to our democracy,” used fabricated evidence from one candidate to spy on employees of the opposing candidate. Then, when the target of their phony investigations won, they tried to run him out of office using the same phony crap. The Deep State lied, and the Media swore it all was true. And even now, years after they finally admitted that the Trump/Russia Collusion allegations were all a hoax, lying She-Wolf, Crooked Hillary Clinton, is still calling Donald Trump a Russian stooge. Heads should have rolled long ago. The other day Trump hit the right tone. Asked if he sought revenge, he said no, “my success will be the revenge.” That sounds good, but it’s really not enough.
